(Per : HONOURABLE MR.JUSTICE P.B.MAJMUDAR) Learned Senior Counsel Mr.Dave frankly states that the appellant has already deposited 50% amount with the Registry and since it is money claim, the appellant will deposit remaining amount directly with the Kandla Port Trust without prejudice to his rights and contentions that the Kandla Port Trust was not authorized to charge such amount. He further states that appropriate order may be passed in case the appeal is allowed regarding refund of the amount with interest. The said statement is recorded. Kandla Port Trust is also permitted to withdraw 50% amount deposited by the appellant before the Registry of this Court.
