1. Mr.
Niraj Sharma, learned AGP places on record the communication dated 21.1.2012 addressed by the Deputy Secretary to the State of Gujarat in Narmada, Water Resources and Water Supply and Kalpasar Department addressed to Executive Engineer of Ukai. The same is taken on record. It is indicated in the said communication that no recovery shall be made from the petitioner.
2. Learned AGP further states that the respondent authorities have calculated the pension by considering the pay scale of Rs.750/-.
3. However, Ms. Bhatt, learned advocate for the petitioner submits that since refixation of pay scale from Rs.750/- to Rs.950/- was already made, the pension should also be fixed accordingly.
4. In view of the above, the respondents are directed to deposit an amount of pension before this Court within a period of one week from today.
