JUDGMENT / ORDER

The petitioner is aggrieved with the non-issuance of a regular permit, which is granted as per Ext.P1. As per Ext.P1 order of the RTA, Ernakulam, the petitioner is granted with regular permit on the route North Parur - Vyttila and the current records of the vehicle bearing registration No.KL-13/H 5699 was also produced as per Ext.P2. Ext.P3 is the notification issued for settlement of timings, which clearly indicated the registration number of the vehicle produced. 2. Subsequently, the petitioner sold the vehicle before the issuance of regular permit and purchased another vehicle bearing registration No.KL-18/A 1561. The petitioner also approached this Court requesting to issue regular permit already granted in respect of the stage carriage subsequently proffered and by Ext.P6, this Court directed consideration of the request for change of vehicle. There was no replacement as such since W.P.(C) No.26593 of 2014 -: 2 :-
at that point of time, there was no issuance of regular permit.

Ext.P7 order is passed by the RTA, Ernakulam pursuant to Ext.P6 judgment, wherein, the current records of the vehicle presently offered was considered and the Secretary was directed to grant permit after settlement of timings in respect of the vehicle bearing registration No.KL-18/A 1561. Nothing has transpired thereafter is the petitioner's contention.

In such circumstances, there shall be a direction to the Secretary, RTA, Ernakulam to expedite compliance of Ext.P7 and convene timing conference, at any rate, within three months from today and issue regular permit as soon as the timings are settled. In the mean time, the petitioner's application for temporary permit, Ext.P9 shall be considered and the petitioner be issued with the same within a period of one week from today, on the proposed timings.
The Writ Petition is, accordingly, allowed.
