JUDGMENT / ORDER

Petitioner is the 1st accused in Crime No.453 of 2014 of the Pathanamthitta Police Station for the offences punishable under Sections 341, 323 and 394 of the Indian Penal Code, apprehends arrest and has filed this application. 2. Learned Public Prosecutor has opposed the application.
It is submitted that on the relevant day and time while the de facto complainant was driving his autorikshaw, the petitioner and another assaulted him and forcibly took Rs.13,750/- from his pocket. It is further submitted that the petitioner is accused in Crime No.2067 of 2012 of the Adoor Police Station and in that case final report is filed.
3. Learned counsel submitted that the allegations are not true. It is submitted that due to political enmity the petitioner is falsely implicated. It is submitted that if at all petitioner is involved in Crime No.2067 of 2012 that has no relevance so far as the present case is concerned.
4. While considering the request for pre-arrest bail I have

to consider the interest of the Society as well for which reference to other cases involved by the accused is to be looked into. In the nature of the allegations made and the investigation required to be done, request made by the petitioner for pre-arrest bail cannot be allowed. In case the petitioner is arrested, he shall be produced before the jurisdictional magistrate as early as possible.
Application is disposed of as above.
