JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) Learned counsel, Mr.Dipen Desai, appearing for the appellants submitted that, since the appeals are preferred from an interim order in the petitions pending before learned Single Judge and due to the development of promotions having already been granted to the contesting respondents, the appeals are not required to be pressed with a view to requesting learned Single Judge to hear main petitions as early as practicable. Learned counsel, Mr.N.K.Majmudar, appearing for the contesting respondents conceded that, in view of grievances made by the appellants, the respondents would cooperate in the earliest practicable hearing and disposal of main petitions. Under the circumstances, the appeals are permitted to be withdrawn with the observation that in view of assured cooperation of learned counsel on both sides, learned Single Judge may grant appropriate priority to the hearing of main petitions. Civil Applications do not survive in view of this order. Accordingly, Letters Patent Appeals as well as Civil Applications are disposed with no order as to costs.
