1. Upon hearing Mr.Shah for the appellants, Mr.Kamal B. Trivedi, learned Advocate General with Mr.Merchant for respondents 1 to 3 and Mr. C.B.Upadhyay for respondent no.4, it appears that considering the facts and circumstances, it would be just and proper that if the LPA is finally heard after the disposal of SCA Nos.2307/09 and 2309/09 which is pending before the learned Single Judge challenging the legality and validity of the order of the Charity Commissioner dated 04.10.2008.
2. Hence, office to place the appeal for hearing LPA/1610/2010 2/2 ORDER after the note is filed by either side stating that SCA Nos.2307/09 and 2309/09 is finally disposed of.
3. It would be open to the parties to move the learned Single Judge for early hearing of SCA Nos.2307/09 and 2309/09.
4. The learned counsel appearing for both the sides have also declared that they shall cooperate for early hearing of the aforesaid both the petitions before the learned Single Judge.
