Heard learned counsel for the petitioners and Shri Amresh Singh for the Gaon Sabha as also learned Standing counsel for the State-respondents.
Petitioner is aggrieved by an allotment made by the Gaon Sabha. In its regard, he has made a representation on 02.08.2019 to the District Magistrate highlighting illegalities committed, while making the allotment.
In my considered opinion, a representation is not the method for seeking cancellation of allotment. The petitioner may institute proper proceedings under Section 128 of the U.P. Revenue Code, 2006 for redressal of his grievance.
It is, however, observed that in case a proper application under Section 128 of the U.P. Revenue Code, 2006 is filed within a period of 10 days from today, it is expected that the same shall be dealt with as expeditiously as possible.
