(Per : HONOURABLE MR.JUSTICE C.L. SONI) This application is filed for directing the Claims Tribunal to disburse the compensation awarded by it in MACP No.229/2007.
We find that Civil Application for stay in the First Appeal was disposed of vide order dated 27.9.2011 with cognate Civil Applications in First Appeals and in cognate Civil Applications for stay, this Court permitted withdrawal of 20% of the amount awarded by the tribunal. So far as the claimants of this application is concerned, it seems nobody had appeared at the relevant time on behalf of the claimants. The stay was confirmed with liberty to the claimants to file appropriate application for withdrawal of the amount deposited by the respondents in the Claims Tribunal. Since this Court has already passed order permitting the claimants in other appeals to withdraw 20% of the amount, the applicants claimants here also are required to be permitted to withdraw 20% of the amount deposited by the respondents with proportionate costs and interest.
Accordingly, we allow this application and permit the applicants claimants to withdraw 20% of the amount deposited by the respondents and we also direct that remaining 80% shall be invested by the tribunal in FDR in any nationalised bank initially for a period of five years to be renewed from time to time till the appeal is finally decided. We also permit the applicants to withdraw periodical interest on the FDR.
With above observations, the petition is disposed of.
