1. RULE.
Shri Siddharth Dave, learned advocate appearing for Shri Ajay Mehta, learned advocate waives service of notice of rule on behalf of respondents nos. 4/2 to 4/4, who are also the heirs of original respondent no. 4/1-Ramanlal Maganlal Desai (now deceased).
2. In the facts and circumstances of the case and with the consent of the learned advocates appearing on behalf of the respective parties, the present application is taken up for final hearing today.
3. The present application has been preferred by the applicants permitting them to bring the heirs and legal representatives of original respondent no. 4/1-Shri Ramanlal Maganlal Desai (now deceased) on record by describing respondents nos. 4/2 to 4/4 as heirs and legal representatives of original respondent no. 4/1.
4. Having heard the learned advocates appearing on behalf of the respective parties and as the application is within the period of limitation, the applicants are permitted to bring respondents nos. 4/2 to 4/4 as heirs and legal representatives of original respondent no. 4/1-Shri Ramanlal Maganlal Desai (now deceased) as respondents nos. 4/1/1 to 4/1/3.
5. With this, the present application is allowed. Rule is made absolute accordingly. No cost.
6. Registry is directed to amend the cause title of main Second Appeal as well as Civil Application No. 5825/2012 accordingly.
