Present Second Appeal under Section 100 of the Code of Civil Procedure, 1908 has been preferred by the appellants herein - original defendants to quash and set aside the impugned judgment and order passed by the learned Assistant Judge, Kheda at Nadiad in Civil Appeal No.15 of 1995.
Today, when the present Second Appeal is taken up for final hearing, Ms. Mohini Bhavsar, learned advocate appearing for Shri Bharat Jani, learned advocate appearing on behalf of the appellants has stated at the Bar that despite several attempts, Shri Jani has not been in a position to contact the appellants. Therefore, it is requested to pass appropriate order of dismissing the present Second Appeal for want of instructions by the learned advocate appearing on behalf of the appellants.
In view of the above, present Second Appeal is dismissed for want of further instruction by the learned advocate appearing on behalf of the appellants.
