Legal vs Bhurala

High Court Of Gujarat|08 May, 2012

JUDGMENT / ORDER

1. This appeal has been preferred against the judgment and award dated 07.06.2011 passed by the Motor Accident Claims Tribunal (Aux.), Surendranagar in M.A.C.P. No.961/1998 whereby, the claim petition was allowed in part.
2. The aforesaid claim petition was preferred in connection with the vehicular accident that took place on 26.04.1998 at around 0630 hrs., involving the Bus bearing registration No. MP-04-H-7311 and Tanker bearing registration No. GJ-18-T-204 and in which Sumanbhai Kasturchand had expired.
3. Heard learned counsel for the appellants. Having gone through the impugned award, I find that the Tribunal has dealt with every aspect of the case in detail. The Tribunal appreciated the evidence on record in its proper perspective and has awarded compensation, which, in my view, is just, legal and appropriate. Learned counsel for the appellant was not in a position to point out any illegality or impropriety having been committed by the Tribunal while deciding the claim petition. I am in complete agreement with the reasonings given by the Tribunal in its award and hence, find no reasons to entertain this appeal.
4. For the foregoing reasons, the appeal is dismissed. No order as to costs.
