In view of statement of witnesses, (a copy of which has been annexed as Annexure 2 to the affidavit) prima facie, a case for grant of an interim relief is made out.
Learned A.G.A. has accepted notice on behalf of opposite party no. 1.
Issue notice to opposite party no. 2 returnable at an early date.
Four weeks time is granted to opposite party no. 2 as well as learned A.G.A. to file counter affidavit. Rejoinder affidavit may be filed within three weeks thereafter.
List thereafter.
Until further orders of this Court, further proceedings of Case No. 565 of 2012 (State Vs. Layak Singh Singh and others), under Sections 498A, 323, 504, 506 I.P.C. and 3/4 D.P. Act, P.S. Tajganj, District Agra pending in the court of Additional Chief Judicial Magistrate, 1st, Agra shall remain stayed as against the applicants.
