The petitioner claims that he belongs to weaker section of the society and is an agriculturist. His grievance is that respondent nos. 3 to 6 who are powerful persons are trying to grab his agricultural land. He has stated that he is a very poor person and in case the private respondents are successful in grabbing his property, he will be deprived of his only source of livelihood.
Ordinarily the Courts do not interfere in such type of disputes where the matter of property is involved, however, taking into consideration the facts of the present case we are of the view that the ends of justice requires that grievance of the petitioner be addressed at the first instance by the competent authority.
Accordingly, we direct the District Magistrate, Mirzapur to look into the grievance of the petitioner and pass appropriate order in accordance with law after furnishing opportunity to respondent nos. 3 to 6 expeditiously. We are not issuing any notice to respondent nos. 3 to 6 as we have directed the District Magistrate to pass the order after furnishing opportunity to them. We also make it clear that we have not expressed our opinion on the merits of the case, the District Magistrate shall pass the order independently and in accordance with law.
The writ petition stands disposed of. No order as to costs.
