Heard learned counsel for the applicant.
This application has been filed by the wife of opposite party for transferring the Case No. 2414 of 2018 (Ravi Kumar Vs. Smt. Laxmi @ Soni), under Section 9 of the Hindu Marriage Act from the court of Principal Judge, Family Court, Ghaziabad to Etah.
In the affidavit filed in support of the application, it has been stated that the applicant has no source of money and the other cases are pending in district Etah. The distance from Ghaziabad to Etah is 250 kms.
Office report of 28.11.2019 is that the notice issued to the sole respondent fixing 18.11.2019 has been received back undelivered with the post office remark that it was refused.
In view of the refusal to accept the notice sent by registered post, notice is deemed to have been served on the opposite party.
Neither any appearance nor any counter affidavit in reply to the petition has been filed.
Considering the facts and circumstances of the case, this application is allowed and the aforesaid Case No. 2414 of 2018 is transferred from Ghaziabad to Etah.
