The petitioner has challenged the order passed passed by the Deputy Director, Consolidation whereby he has transferred Case No. 02474 of 2018 to the Court of Deputy Director, Consolidation, Varanasi.
Learned counsel for the petitioner submits that earlier the second respondent had moved a transfer application and the case was transferred from the court of Deputy Director, Consolidation to the Additional District Magistrate (City), Varanasi. A copy of the said is on the record as annexure-3 to the writ petition. He submits that now on the application of the third respondent the matter has been transferred to the Deputy Director, Consolidation.
Learned Standing Counsel submits that the impugned order has not caused any prejudice to the interest of the petitioner hence the writ petition is misconceived.
I have heard learned counsel for the parties and perused the record.
On an application moved by the second respondent previously the matter was transferred from the Court of Deputy Director, Consolidation, Varanasi to the Additional District Magistrate (City). It appears that two separate applications have been filed against the order dated 28.10.2016. The D.D.C. while passing the impugned order has taken the view that since two separate applications have been filed against the order dated 28.10.2016 hence he has transferred the matter to the D.D.C., Varanasi.
I do not find any error in the order impugned. The petitioner has failed to point out any serious prejudice caused to him. Accordingly, the writ petition lacks merit and it is dismissed.
No order as to costs.
