This writ petition has been filed, inter alia , for the following relief:
"Issue a writ,order or direction to issue ad- interim mandamus commanding respondent no. 3 to direct the respondent no. 5 to pay the rest amount of construction of Nali and Interlocking road from Mahoba road to Railway Line(Sankat Mochan road) in the nagar Palika Parisad, Banda Rs 99500/- to petitioner within stipulated period as fixed by this Hon'ble Court."
At the very outset, Mr. Abhishek Rao holding the brief of Mr. Abhinav Ojha, learned counsel for the respondents no. 3 to 5 stated that the claim of the petitioner is justified and the respondents are ready to pay the same provided some reasonable time may be granted to them for making payment of the entire amount as claimed by the petitioner.
Considering the facts and circumstances of the case and the statements made by the learned counsel for the respondents no. 3 to 5, we direct the respondent no. 4 to make payment of the entire outstanding amount to the petitioner within a period of three months positively from the date of receipt of a certified copy of this order.
With the above observation writ petition stands disposed of.
