Heard learned counsel for the petitioner and Sri Santosh Kumar Mishra, learned counsel appearing for the respondent Corporation.
The instant writ petition has been preferred principally seeking the following relief:
"i) to issue a writ, order or direction in the nature of mandamus commanding the respondents to consider the petitioner's claim for reimbursement of medical expenses incurred as OPD patient as well as IPD patient and pay the same along with stipulated rate of interest to the petitioner within short span of time."
Sri Mishra, learned counsel appearing for the respondents submits that on 29 July 2021, due to inadvertence and mixing up of instructions which were provided to him an inaccurate statement was made before the Court. He prays for and is consequently granted permission to withdraw and retract the same. Sri Mishra further apprises the Court today that the claim of the petitioner for medical reimbursement is not liable to be acceded to since the respondents have found upon due enquiry that he was never admitted for treatment in any medical facility and the claim is clearly based on forged and fabricated documents. However, the Court notes that no such decision has been formally communicated to the petitioner till date. Consequently, the respondent No. 2 is directed to communicate a final decision with respect to the claim of the petitioner for medical reimbursement with expedition and in any case within a period of one month from today. All contentions of respective parties on merits are kept open.
Petition stands disposed of accordingly.
