Heard learned counsel for the petitioner, learned Standing Counsel for the respondents no.1, 2 and 4 and Sri Kaushalendra Nath Singh, learned counsel for the respondent no.3.
This writ petition has been filed by the petitioner with the following prayers:-
"(i) issue a suitable writ, order or direction in the nature of MANDAMUS commanding the Respondent No.3 to forthwith lease back in favour of petitioners their abadi land being Khasra No.139M area 0-11-5 bigha situated in Revenue Village Chhajarsi, Pargana and Tehsil-Dadri, District Gautam Budh Nagar.
(ii) issue a writ, order or direction, in the nature of MANDAMUS commanding the respondent authority to decide the representation of the petitioner dated 14.01.2019 (Annexure no.6 to this writ petition)."
Having perused the averments made in the writ petition and the documents appended thereto, we find that for redressal of his grievance, the petitioner has already filed her representation on 27.3.2019, copy whereof has been filed as Annexure-6 to the writ petition, before respondent no.4, but the said representation has not been decided till date.
In view of above, without expressing any opinion on the merits of the case, we dispose of the writ petition with the direction to respondent nos.3 and 4 to decide the said representation filed by the petitioner before him on 14.1.2019 (Annexure-6), within a period of one month from the date of filing of the certified copy of this order before him, strictly in accordance with law, by a speaking and reasoned order.
