The sole prayer made in the instant petition is for issuing direction to the Appellate Authority, before whom Rent Control Appeal No.5 of 2009 is pending, to decide the same expeditiously within a specified time frame.
The petitioners are landlord of a premises which is in tenancy of Subhash Babu. The release application was allowed by the Prescribed Authority and aggrieved whereby the tenant has filed the appeal. A perusal of the order sheet reveals that although the matter is pending since a long time, but the appellate court is granting adjournment to the tenant as a matter of course.
In such view of the matter, the instant petition is disposed of by directing the Appellate Authority to make serious endeavour to decide the appeal expeditiously, without granting unnecessary adjournments to the parties, preferably within a period of two months from the date of production of a certified copy of this order, provided there is no legal impediment.
