… Respondents THE HON’BLE SHRI JUSTICE SANJAY KUMAR WRIT PETITION NO.6156 OF 2004 O R D E R There was no representation for the petitioner or her counsel when this matter was taken up for hearing on 26.08.2014, despite the matter being passed over. It was accordingly directed to be listed under the caption ‘For Dismissal’ on 27.08.2014. On the said day, this Court found that the third and fourth respondents remained un-served and permitted the learned counsel for the petitioner to take out notices to them by Registered Post with Acknowledgment Due and file proof of service. The matter was accordingly adjourned to 12.09.2014.
Today, though the matter was passed over during the morning session, there is no representation for the petitioner when it is taken up for hearing in the afternoon session. Further, there is no evidence of service of notice on the third and fourth respondents.
The writ petition is therefore dismissed for non-prosecution. Interim suspension dated 01.04.2004 shall stand vacated. Pending Miscellaneous Petitions, if any, shall also stand dismissed. No order as to costs.
