In the present case, contention of the applicant is that pursuant to final judgment and order dated 07.10.2010 passed in writ petition No.15928 of 2008, Laxmi Mohan Sharma vs. State of U.P. and others, till date requisite exercise has not at all been undertaken by opposite party No. 2, inasmuch as, said authority was obliged to determine the matter within three weeks from the date of production of certified copy of the said judgment. It has been stated in paragraphs 9 and 10 of this application that certified copy of the judgment had been duly served and on 08.12.2010. The applicant also visited the office of opposite party No.2, then it was informed that the copy of judgment had been duly served.
In view of the submissions made above, let notice be issued to opposite party No. 2 as to why proceedings under Contempt Court Act be not initiated against him for noncompliance of the judgment passed by this Court dated 07.10.2010 passed in writ petition No.15928 of 2008, Laxmi Mohan Sharma vs. State of U.P. and others.
List after one month. On the next date in case any decision has been taken pursuant to judgment dated 07.10.2010 passed by this Court, copy of the same may be appended along with affidavit. Opposite party No.2 may appear through counsel.
