Heard learned counsel for the petitioner and Sri Alok Sharma, learned Additional Chief Standing Counsel for respondent nos.1 to 4.
In view of the order proposed to be passed, notices against respondent nos.5 and 6 are dispensed with.
Grievance of the petitioner is that while working on the post of Peon from Rashtriya Ashram Inter College, Matiyari, Chinhat, Lucknow, he retired from service from the post of Daftari on 31.8.2012, but till date, benefit of third A.C.P. has not been paid to the petitioner.
Learned counsel for the petitioner submits that arrears of salary in the shape of third A.C.P. has not been paid to the petitioner, for which he has represented his claim before respondent no.3 who is keeping the matter since long and is not passing the order. He further submits that last representation in this regard has been made to respondent no.3 on 20.11.2020 and till date, no order whatsoever has been passed. His last submission is that in case direction is issued for deciding the last representation filed on 20.11.2020, the controversy of the writ petition shall be resolved and justice would be met.
On the other hand, learned Additional Chief Standing Counsel submits that in case claim set up in the writ petition has been represented by the petitioner before respondent no.3 and is pending consideration, the same shall be considered and appropriate order shall be passed within a reasonable period.
In view of the submissions advanced by learned counsel for the parties, no useful purpose will be served in keeping this writ petition before this Court.
Accordingly, this writ petition is finally disposed of with a direction to respondent no.3 i.e. District Inspector of Schools, Lucknow to consider and pass appropriate order on the representation dated 20.11.2020 (Annexure-7 to the writ petition) within a period of eight weeks from the date of production of a certified copy of this order.
