Heard learned counsel for the petitioner and perused the record.
Present petition has been filed with a prayer to direct the learned Additional District Judge, Court No. 7, Aligarh- respondent no.1 to decide the Misc. Case No. 54 of 2014, under Section 174 Motor Vehicle Act arising out of Motor Accident Claim Petition No. 42 of 2011 (Smt. Laxmi Devi Vs. Subedar Singh and others) awarding claim by the judgment and award dated 31.01.2014 pending before the court of learned Additional District Judge, Court No. 7, Aligarh within a time bound period.
Submission of the learned counsel for the petitioner is that the award was passed on 31.01.2014 and execution is pending since 2014 but till date no substantial progress has taken place in the execution proceeding. It is further submitted that the petitioner is a widow lady having three minor children to maintain.
In the facts and circumstances of the case, the present writ petition is finally disposed of with the direction to the learned Additional District Judge, Court No. 7, Aligarh to expedite the hearing of the petition and decide the same on its own merit, in accordance with law, expeditiously and no unnecessary adjournments shall be granted to the parties.
With the aforesaid observations/ directions, the present writ petition is finally disposed of.
