The present 482 Cr.P.C. application has been filed to quash the cognizance order dated 01.05.2019 as well as the entire proceedings of Case No. 1361 of 2019 (State Vs. Pankaj Chandra and others), arising out of Case Crime No. 442 of 2017, under Sections- 419, 420, 467, 468, 471 and 120-B I.P.C., Police Station- Nagar , District- Basti, pending in the court of Chief Judicial Magistrate, Basti.
Submissions is that order of cognizance has been passed without application of judicial mind by printed proforma on 01.05.2019. In view of the above fact that the order of cognizance has been passed without application of mind the same is hereby set aside. It is open for the Magistrate to pass fresh order in accordance with law.
The application is allowed.
