In view of the uncontroverted averments Page 1 of 2 C/CA/7436/2012 ORDER that, persons stated in paragraph No.5 of the application are the legal heirs and representatives of the deceased respondent No.2, as also learned Counsel for the respondents having no objection, the application is allowed. The legal heirs and representatives of respondent No.2 as stated in paragraph No.5 of the application shall be brought on record. Amendment shall be carried out accordingly.
3. Civil Application No.14062 of 2012 is filed seeking setting aside of the abetment of First Appeal No.1259 of 2002. In view of the aforesaid order and by consent of the parties, the abetment of the First Appeal is set aside qua the concerned deceased.
4. Rule is made absolute accordingly.
