Laxmanji vs State

High Court Of Gujarat|07 May, 2012

JUDGMENT / ORDER

Draft amendment is granted. The same shall be carried out forthwith.
Learned advocate for the applicant has invited this Court's attention to the averments made on page no.36 which happens to be representation to the respondent no.4, wherein it is categorically alleged that the Crime Branch personnel are involved in the perpetration of offence against the applicant. The applicant had to move this Court on earlier occasion for seeking even registration of complaint, as the complaint is not getting registered. Having registered the complaint, unfortunately, the respondent no.4 ordered transfer of the investigation to the very Crime Branch against whom the applicant has serious grievances with regard to the involvement. Theses allegations are made and they are forming part of the record also. The statement of the learned counsel is coming forward under instruction.
This Court is of the view that let there be a notice returnable on 18.06.2012, calling upon the respondent no.4 to explain as to why the petition shall not be allowed by way of affidavit.
