The writ petition has been taken up through video conferencing. It is accompanied with an application for urgency which on consideration is allowed.
Notice on behalf of opposite parties 1,2,3 and 5 has been received by learned Chief Standing Counsel, however notice for opposite party No.4 has been received by Mr. Ajay Kumar learned counsel. For the order proposed, no need to issue notice to private respondent No. 6 to 9.
Writ petition has been filed seeking following reliefs:-
" Issue a writ, order or direction in the nature of Mandamus commanding and directing the opposite party no.2,3 and 5 to remove/demolish the other newly gate which is stand by the opposite party no. 6 to 9 on the back side of boundary wall of the said Vidhyalaya which is open in front of house of the opposite party no.6 in the interest of justice.
ii. Issue a writ, order or direction in the nature of Mandamus commanding and directing the opposite party no.2 and 3 to provide the some special force for conducting the peaceful election in the village panchayat Meura, Tehsil Bilgram, District Hardoi for stopping the booth capturing which can be done by the opposite party no. 6 to 9 in the interest of justice."
After hearing the learned counsel for petitioner and going through the record, we do not find any reason to grant indulgence on mere apprehension of the petitioner that the fair and proper election in village panchayat Meura, Tehsil Bilgram, District Hardoi would not be held.
The writ petition is accordingly dismissed, however it is needless to observe that it is the bounden duty of the concerning authorities to ensure that the incoming panchayat elections are held in a proper and fair manner.
