List has been revised. Nobody is present for the petitioner. Learned Standing Counsel is present for the respondent.
The applicant is before this Court for a direction to initiate contempt proceeding against the opposite parties for willful disobedience of the order dated 1.8.2018 passed in Writ Petition No.25768 of 2018 (Laxman Singh Vs. State of U.P. and Others). The operative portion of the order is reproduced hereinbelow:-
"In view of the aforesaid facts and circumstances, we permit the petitioner to move a representation in this regard before the respondent no.-2 Collector, Bulandshahar in accordance with the Government Order dated 12.05.2016 and it is expected that the District Magistrate could consider the same and after due verification if the land of the petitioner is illegally occupied by the respondents shall determine the amount of compensation admissible to the petitioner within a period of three months and ensure that the payment is made within a month thereafter.
The writ petition is disposed of accordingly."
It is argued by learned Standing Counsel that in compliance of the order of this court, a decision has already been taken on 29.3.2019 by the opposite party, a copy of the said order is appended as annexure 1 to the affidavit of compliance and no cause of action would further survived and prays for dismissal of the present contempt application.
Since the order of the writ court has already been complied with, therefore, no further order is required.
Accordingly, the present contempt application is dismissed.
In case, the applicant is still aggrieved with the decision of the opposite party, he has liberty to challenge the same before appropriate forum.
