Heard learned counsel for the petitioner and the learned Standing Counsel appearing for the State respondents.
Sri Amresh Singh has accepted notice on behalf of the Gaon Sabha.
No fruitful purpose would be served by keeping this petition pending or calling for counter affidavit.
Present petition has been filed seeking direction to the respondent no. 2 to take appropriate decision on the application of the petitioner dated 14.11.2019.
Submission is that after death of father of the petitioner on 22.9.2019, who was fair price shop dealer, the petitioner is entitled for fair price shop under the Dying in Harness Rules.
Learned Standing Counsel submits that at the first instance the grievance of the petitioner can be looked into by the respondent no. 2.
In such view of the matter, present petition stands disposed of with a direction to the respondent no. 2 to take appropriate decision on the application of petitioner and if required initiate proper proceedings in accordance with law preferably within a period of two months from the date of production of a certified copy of this order before him.
It is made clear that this Court has not examined the claim of the petitioner on merits.
With the aforesaid observations, present petition stands disposed of.
