Heard learned counsel for the parties.
The present application has been filed seeking quashing of the charge-sheet dated 27.12.2019 giving arise to Criminal Case No. 53 of 2020 (arising out of Case Crime No. 519 of 2019) under sections 307, 120-B IPC, Police Station Collector Bukganj, District Bareilly.
The contention of counsel for the applicant is that the son of the victim had lodged an FIR alleging that at the instance of the applicant, the opposite party no. 2 was dismissed from the service in the factory and at his instance three persons attacked and caused injuries to the victim. He argues that no role was attributed to the applicant even in the statement of the informant as well as the statement of the injured and the statement of the eye witness, one of the said statement the eye witness is on record.
On perusal of the statements and the allegations contained in the FIR, no case for quashing the charge-sheet is made out.
The application u/s 482 Cr.P.C. lacks merit and is, accordingly, rejected.
