5. Sri Devegowda S/o. Late Devegowda Aged about 70 years R/at Kothathi Village Kothathi Hobli, Mandya Taluk Mandya District – 571 471. …RESPONDENTS (By Sri T.S. Mahantesh, AGA for R1 to R4) This Writ Petition is filed under Articles 226 and 227 of the Constitution of India praying to quash the orders dated 28th February 2011 in R.P. No.40/2009 passed by the 2nd Respondent, Mandya vide Annexure-E as arbitrary, etc.
This Writ Petition coming on for orders this day, the Court made the following:-
ORDER This writ petition was filed on 25.03.2013 with certain office objections. After compliance of office objections, an order was passed on 29.09.2016 directing learned Additional Government Advocate to take notice on behalf of respondent Nos.1 to 4 and for issue of notice to respondent No.5. Thereafter, steps have not been taken for issuance of notice to respondent No.5 till today.
Though the petitioners have filed the petition in 2013, till today they have not bothered to take steps for issue of notice to respondent No.5. In the meanwhile, it is seen that there is no representation on behalf of the petitioners on more than one occasion and hence, this Court finds no justification to keep this petition pending.
Writ petition is dismissed for non-prosecution.
