1. Instructions and Counter affidavit filed today are taken on record.
2. Sri Laloo Yadav, learned counsel for the petitioner and Sri Arvind Nath Agrawal, learned counsel for the respondents.
3. Sri Arvind Nath Agrawal, learned counsel for the respondents submits that petitioner- Lawkush Kumar secured less marks then the qualifying marks. It is submitted that cut-off marks of last selected male candidate in Bihar State under OBC/Naxal/Border Category is 75.33451 (N) & 67.23113 (B). If he qualified in RME, still he will not find place in list of final provisionally selected candidates, against which petitioner had secured only 65.78 marks and, therefore, having not made to the list of cut-off marks, his candidature has been rejected.
3. This issue has not been disputed by Sri Laloo Yadav, learned counsel for the petitioner. Therefore, petition has been rendered infructuous as petitioner has not been able to secure cut-off marks as provided under the scheme of examination.
5. Petition is dismissed as infructuous.
