Heard Learned counsel for the applicant as well as learned AGA and perused the record.
The accused applicant lavkesh Bhatt is involved and detained in Case Crime No. 108/2010 under Sections 8/21/22 N.D.P.S. Act from Police Station G.R.P. Charbagh, District- Lucknow. Submission of the learned counsel for the applicant is that police has arrested the accused applicant and recovered 135 gram Dyezipam powder from his possession while no such Dyezipam powder had been recovered from his possession. The police has falsely implicated the accused applicant under Section 50 of the N.D.P.S. Act. No compliance of mandatory provisions has been done by the recovery officer. Therefore, the applicant deserves to be released on bail. Learned AGA opposed the bail application.
Considered the submissions of the learned counsel for the applicant and the learned AGA. Keeping in view the facts and circumstances of the case, without expressing any opinion on the merits of the case, accused applicant may be released on bail.
Let the applicant Lavkesh Bhatt be released on bail in aforesaid case crime number on his furnishing a personal bond with the two sureties each in the like amount to the satisfaction of the court concerned.
