(Per : HONOURABLE MR.JUSTICE PARESH UPADHYAY) By way this application, the applicant - convict has prayed for modification of the conditions imposed by this Court while ordering enlargement of the present applicant on temporary bail for a period of 10 days as ordered by this Court on 24.4.2010 in Criminal Misc. Application No.5476 of 2012.
The cause to enlarge the present applicant - convict on temporary bail was to attend the marriage in the family of his daughter. By this time, the marriage is already over and the cause does not survive.
Under these circumstances, no purpose would be served by entertaining the present application for modification of the conditions. Hence, the application is rejected. However, we also find that since the cause for enlargement of the present applicant - convict on temporary bail does not survive, the order dated 24.4.2012 passed by this Court in Criminal Misc. Application No.5476 of 2012 need not to be implemented. Therefore, the order dated 24.4.2012 passed in Criminal Misc. Application No.5476 of 2012 is recalled.
The application is disposed of accordingly.
