(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application has been preferred by the applicant-convict for temporary bail on the ground that the surgery of his wife is fixed and he wants to take care of the treatment.
Pursuant to the earlier order passed by this Court, learned APP states that he has talked to the Doctor and as reported by the Doctor, the operation is fixed today at 4 O'Clock. Under the circumstances, the ground is genuine.
Earlier the jail report shows that he had surrendered, but there was one day delay, for which the application is pending, of which the decision is yet to be taken.
Learned counsel states that she shall not come with the further extension.
Under the circumstances, the applicant be released on temporary bail for a period of 10 (ten) days from the date of his actual release on personal bond of Rs.5,000/- (Rupees Five Thousand Only) with one surety of like amount and with the further direction that upon the expiry of the period, he shall surrender with the jail authority.
Application disposed of accordingly. Rule made absolute. Direct service is permitted.
