JUDGMENT / ORDER

Petitioner has approached this Court complaining about the inaction on the part of the 2nd respondent in disposing of a complaint filed as Ext.P1 under Section 133 Cr.P.C.
2. According to the petitioner, despite the fact that the complaint is filed on 06/02/2014, no action has been taken so far. The averments in the complaint disclose that the 3rd respondent has encroached into the thodu which caters to the need of the nearby paddy lands.
3. Counter affidavit is filed by the 3rd respondent disputing the aforesaid allegations. According to the 3rd respondent, he has not encroached into any portion of the ‘thodu’ and even as per the report of the Village Officer available with the Revenue Divisional Officer, no such encroachment is reported. That apart, it is contended that there is a civil dispute between the petitioner as well as the W.P.C.No.7483/2014 2 3rd respondent which has resulted in Ext.P2 complaint before the Revenue Divisional Officer.
4. The learned Government Pleader, on instructions, would submit that the Revenue Divisional Officer has taken necessary steps to dispose of Ext.P2 on the basis of the report received from the Village Officer.
Having regard to the aforesaid facts and circumstances, I am of the view that there is no reason to pass any judgment on the merits of the case. However, the 2nd respondent is directed to consider Ext.P1 and pass appropriate orders within a period of two months from the date of receipt of a copy of this judgment, in accordance with the procedure prescribed and the order so passed shall be communicated to the petitioner as well as other contesting parties.
This writ petition is disposed of as above.
