The appeal is taken up for hearing. Learned A.G.A. is present for the State.
I have perused the office report dated 12.08.2021/23.08.2021 which reveals that as per the report of learned Chief Judicial Magistrate-Amroha dated 12.03.2020 the sole-appellant Lateef S/o Allah Bux had died. I have also gone through the statements of S.I. Dharmendra Kumar, Om Prakash (Vadi) and Om Dutt (Village Pradhan) which reveals that the sole-appellant Lateef had died on 08.04.2005. The report is in compliance of Circular of this Hon'ble Court being Circular Letter No.15/2005: VIIIb- 119: Dated April 19, 2005 and Circular Letter No.04/Admin. G-ii dated: Allahabad 18.1.2017.
In above circumstances, it is proved that the sole-appellant Lateef S/o Allah Bux had died, therefore, the appeal stands abated.
It is, accordingly, dismissed as abated.
