For Petitioner : Mr.S.Kumara Devan For Respondent : Mr.C.Emalias, APP ORDER This Criminal Original Petition has been filed seeking a direction to the Additional District Sessions Court, Hosur to complete the trial in SC No.240 of 2004 within the stipulated period as fixed by this Court.
2. The case of the petitioner is that he is cited as L.W.5 in SC No.240 of 2004, on the file of the Additional District Sessions Court, Hosur. In respect of the occurrence took place in the year 1995, the said criminal proceedings was initiated. After travelling various proceedings, the same was committed to the Sessions Court and renumbered as SC No.240 of 2004 in the year 2004 itself. However, till date, no witness has been examined by the prosecution. Apprehending the possibility of tampering the witnesses by the accused, the petitioner has come up with the present petition for the above stated relief.
3. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor, who took notice for the respondent.
4. Considering the facts and circumstances of the case and taking note of the fact that the Sessions Case is of the year 2004, this Court directs the learned Additional District Sessions Judge, Hosur to complete the trial and dispose of the case in SC No.240 of 2004 as expeditiously as possible, preferably, within a period of six months from the date of receipt of a copy of this order.
5. Accordingly, the Criminal Original Petition is disposed of.
