Heard Mr. Gaurav Singh, learned counsel for the applicant, Mr. Nitin Sharma, learned counsel for opposite party No. 2 as well as learned Additional Government Advocate representing the State.
Mr. Nitin Sharma, learned counsel for opposite party No. 2 as well as learned Additional Government Advocate raised a preliminary objection that at present applicant, Lata Singh @ Lat Virendrapratp Singh is residing in United States of America since 20th of June, 2019, therefore, the present application on her behalf is not maintainable at this stage.
On the said preliminary objection, learned counsel for the applicant submitted that he does not want to press this application at this stage and he may be permitted to withdraw the same with liberty to file a fresh application at the appropriate stage.
In view of the statement made by Mr. Gaurav Singh, learned counsel for the applicant at the bar the present application is dismissed as not pressed with liberty to file a fresh application after service of copy of the same upon Mr. Nitin Sharma, learned counsel for opposite party No. 2.
Office is directed to return the certified copy of the impugned charge sheet to the counsel appearing for applicant after retaining the xerox of the same on record.
