Grievance urged in this writ petition is that objection submitted by the petitioner to a provisional assessment under Section 126 of the Electricity Act, 2003 is not entertained, because he is only a tenant in occupation of the premises, and not the registered consumer. It is now remaining settled that who is in possession of the premises upon whom a provisional assessment order is served, is entitled to submit objections.
2. Learned Standing counsel appearing for respondents on instructions submitted that the final order is yet to be passed in the matter. Therefore this writ petition is disposed of by directing the 2nd respondent to consider Ext.P6 objection submitted by the petitioner against the provisional assessment, and to finalise the assessment after affording an opportunity of personal hearing, in compliance W.P.(c) No. 15999/2014 -2-
of procedure contemplated under Section 126 (2 ) & (3) of the Act.
3. Needless to observe that till final order is passed in compliance with the above direction, no recovery steps shall be initiated.
