JUDGMENT / ORDER

This Criminal Original petition is filed for transfer of the investigation in Crime No.157 of 2017 from the file of the 2nd respondent to the file of the 3rd respondent herein.
2. It is stated that the bank robbery was noted on 08.05.2017 by breaking the bank's main door and locker. It is further stated that a sum of Rs.7,83,150/- along with the locker was stolen. In connection with the crime number, a case was registered in Crime No.157 of 2017. Alleging that the second respondent has failed to take any action and there was no progress in the investigation, the petitioner has approached this Court for transfer of investigation.
3. The second respondent had filed a detailed counter, wherein, he has stated that he examined 11 witnesses, apart from collecting several information about the possible involvement of some staff of the bank working in Krishnapuram Branch.
4.Having regard to the details furnished by the third respondent, this Court is able to see that the second respondent has conducted investigation appropriately. Hence, this Court is not inclined to transfer the investigation at this stage, as it is not a right of the petitioner or any one to seek transfer unless there is a valid ground made out. In a case of this nature, the second respondent is not expected to disclose the whole progress which has been made in the investigation.
5.Having regard to the fact that the suspects have to be arrested only after collecting sufficient proof. The delay in investigation is reasonable in this case. Hence, this petition is dismissed. However, the Deputy Superintendent of Police, Kulithalai, is directed to monitor the investigation, so as to ensure that the investigation is in the right direction and there is no undue delay in the completing process.
