JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) MONDAY, THE TWENTY FIFTH DAY OF AUGUST TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No. 21703 of 2014 BETWEEN Lambadi Anshu and others ... PETITIONERS AND The District Collector, Mahabubnagar and others ...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. Petitioners, who claim to be protected tenants of the land to an extent of Ac.55-00 in Survey No.191 situated at Chilakamarri Village, Shadnagar Mandal, Mahabubnagar District, states that there was a dispute arising out of the said claim of the petitioners as protected tenants before the Joint Collector and is stated to be now subject matter of an appeal under Section 90 of the A.P. (TA) Tenancy & Agricultural Lands Act, 1950, pending before the District Collector.
The said appeal is stated to be numbered as Case No.F1/1A-06/2010 and was posted for hearing on 01.08.2010 before the Joint Collector. But since then no further progress was made in the said appeal and the appeal still remains pending and unconsidered. The present writ petition is, therefore, filed against the inaction in considering and disposing of the said appeal.
3. Though the matter was adjourned twice, learned government pleader could not get instructions. But, however, he states that the appeal is stated to be pending before the Joint Collector, which would be disposed of expeditiously.
In the circumstances, therefore, the writ petition is disposed of directing respondent No.1 to consider and dispose of the said appeal either by himself or issue appropriate instructions to the Joint Collector, if the appeal is made over to the Joint Collector, for expeditious disposal of the appeal, in accordance with law, preferably within two months from the date of receipt of a copy of this order. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
