Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
By the order impugned, a first appeal filed against a judgment and decree dismissing the partition suit has been allowed and the matter has been remanded back for fresh consideration to the trial Court.
Against the order impugned, the petitioner has a statutory alternative remedy by means of a second appeal under Section 208 of the U.P. Revenue Code, 2006, which statutory alternative remedy, has not been availed by the petitioner.
Under the circumstances, this writ petition is dismissed on the ground of availability of a statutory alternative remedy.
