JUDGMENT / ORDER

Petition filed under Section 439 Cr.P.C. 2. Petitioners are the accused in Crime No.924/2014 of Pothencode Police Station registered for the offences punishable under Sections 143, 147, 148, 341, 324, 332 and 307 read with Section 149 of the Indian Penal Code.

The allegation against the petitioners is that when a law and order situation had arisen near Ayirooppara junction at 6.15 p.m on 09.10.2014 in a clash between the persons attached to two political groups, the police party under the leadership of the de facto complainant reached there for disbursing the miscreants. Then, they deliberately turned towards him and attacked him, thereby attempting to commit his murder. It seems that very serious injuries were inflicted on him thereby he had to undergo treatment at the Medical College Hospital, Thiruvananthapuram. It seems that A4 to A8 had surrendered before the investigating officer on 20.10.2014 and thereafter, A1 to A3 have surrendered on 27.10.2014.
4. Heard learned counsel for the petitioners and the learned Public Prosecutor.
5. The learned Public Prosecutor has pointed that these petitioners have serious criminal antecedents, as they have been involved in 9 other crimes of Pothencode Police Station. It seems that the said 9 crimes have been registered on the very same day itself, in connection with a series of incidents those had occurred on that day. Apart from those cases, no other criminal antecedents are there on the part of the petitioners. It seems that the investigation is practically over. Continued detention of the petitioners in custody is not required for the continued investigation of the case. Having regard to the period undergone by the petitioners in custody, I am satisfied that the petitioners can be enlarged on bail.

In the result, this Bail Application is allowed and the petitioners shall be enlarged on bail on each of them executing a bond for ₹50,000/-(Rupees fifty thousand only) with two solvent sureties for the like sum each to the satisfaction of the concerned Judicial First Class Magistrate's Court, and subject to the following terms and conditions:-
(i) The petitioners shall report before the Investigating Officer in between 9 am and 11 am on all Thursdays and Mondays, commencing from 18.12.2014 for a period of six months.
(ii) The petitioners shall not tamper with the evidence or influence witnesses.
(iii) The petitioners shall make themselves available for interrogation as and when required by the Investigating Officer.
(iv) The Petitioners shall not involve in any offence while on bail.
It is made clear that the violation of any of the conditions stipulated above will result in the cancellation of bail.
