Learned counsel for the petitioner files supplementary affidavit today bringing on record the photo copy of the order sheet of election petition no. 2 of 2016. The same is taken on record.
Heard Sri Pawan Kumar, learned counsel for the petitioner and the learned Standing Counsel for the respondents no. 1 to 3.
The petitioner in the writ petition is seeking a direction to the respondent no.3 to decide the Election Petition no. 2 of 2016 filed under Section 12 (Ga) of the U.P. Panchayat Raj Act, 1947 read with Section 9 of U.P. Panchayat Raj (Disposal of Election Dispute) Rules, 1992. Copy of the order sheet has been filed as Annexure-1 to the supplementary affidavit.
No useful purpose would be served in keeping the petition pending.
This writ petition is, therefore, disposed of with a direction to the respondent no. 3-Sub Divisional Magistrate, Sadar, Maharajganj to decide the pending election petition no. 2 of 2016 (Lalti Vs District Election Officer, Maharajganj), in accordance with law, expeditiously, preferably within a period of one year from the date of receipt of a certified copy of this order in his office.
