Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This Matters Under Article 227 has been filed with the prayer to direct the Chief Judicial Magistrate, District Jaunpur to expedite the Case No.101 of 2017 (Lalta vs. State of U.P.) arising out of Case Crime No.904 of 2015 pending before the Chief Judicial Magistrate, District Jaunpur.
Learned counsel for the applicant has submitted that the police after investigation has submitted final report against which the petitioner has filed a protest petition on 21.4.2017. However, the said petition is pending since 21.4.2017 and t it has not been disposed of as yet.
Considering the facts and circumstances of the case, learned Magistrate concerned is directed to consider the application and pass appropriate order as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order provided there is no other legal impediment.
With the above observation, this petition is finally disposed off.
