Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the State respondents and Sri Krishna Kant Singh, learned counsel for the gaon sabha and perused the record.
Present petition has been filed with a prayer to direct the respondent no. 2 to decide the applications dated 21.8.2020 and 31.8.2020 pending before him.
Fact of the case are not clear. Perusal of annexure 3 indicates that an application has been filed under Section 67 (1) of UP Revenue Code whereas in fact the petitioner is seeking injunction and perusal of the record indicates that a civil suit no. 93 of 2020 is also pending.
At this stage learned counsel for the petitioner prays that the petitioner may be permitted to withdraw present petition with liberty to avail the remedy as may be available to him in law.
Present petition is accordingly dismissed with liberty aforesaid.
