By means of the instant petition, petitioner is challenging the order dated 29.01.2021 passed by Motor Accident Claims Tribunal/Special Judge (Essential Commodities Act)/ Additional District Judge, Azamgarh in Misc. Case No. 1 of 2014 (Lalsu Vs. Mohd. Arif and others) rejecting the application filed by the petitioner under Order 9 Rule 13 C.P.C.
On being confronted, it is not disputed by learned counsel for the petitioner that the impugned order is appealable under Order 43 Rule 1(d) C.P.C. At this stage, it is submitted that the petition be disposed of as withdrawn with liberty to the petitioner to take remedy in accordance with law.
