Heard Shri C.K. Parekh, learned Senior Advocate for the petitioners.
Challenge in the writ petition is to an order dated 03.12.2019 passed by the respondent no. 4, the Tehsildar, Tehsil Sadar, District Gorakhpur.
From the submissions made as also the perusal of the record, it transpires that the said order has been passed consequent to certain directions issued by the Division Bench of this Court in a Public Interest Litigation.
The contention of learned counsel for the petitioner is that the proceedings between the parties had been finalized up to the High Court and that thereafter under the directions contained in the order passed by the Division Bench in the P.I.L. No. 295 of 2019, the proceedings which has attained finality are being reopened. The proceedings have been drawn consequent to the directions issued in the PIL.
In case, the petitioner is aggrieved, his remedy lies by means of an application before the Division Bench for clarification and or recall or modification of the order on the basis whereof the proceedings, wherein the order impugned came to be passed, were instituted.
Subject to the above, the writ petition stands disposed of.
