Heard learned counsel for the applicant, learned A.G.A. and perused the record.
This bail application has been moved by the applicant Laloo @ Pradeep who is involved in Case Crime No. 506 of 2017, under Sections 379, 411 I.P.C., Police Station- Ramgarh, District-Firozabad.
Learned counsel for the applicant contended that applicant is not named in the FIR and nothing incriminating has been recovered from his possession. Learned counsel for the applicant further contended that co-accused Keshav Dev, Shailendra @ Shailu, Satyendra @ Chhotu, Laloo @ Vipin, Nitu @ Ajay Yadav, Prem Chandra Pandit who have been alleged to be arrested from the spot with tractor have been enlarged on bail by this Court. Lastly, learned counsel for the applicant contended that the applicant has been made accused in this case only on the basis of statement co-accused Satendra @ Chhotu and Laloo @ Vipin. Applicant is in jail since 5.12.2017.
Learned A.G.A., has opposed the prayer for bail, however, admitted this fact that applicant has criminal history of seven criminal cases, in which he is on bail.
Considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail. Let the applicant-Laloo @ Pradeep, be released on bail in the aforesaid case crime number on his furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the C.J.M./Magistrate, concerned.
Application stands allowed.
